THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. It applies to Pearl32 Dentistry and Wellness, a dental practice in Laguna Hills, California, serving the community since 1994, and explains your rights to your dental records under HIPAA and California law.

Who follows this notice

This notice is followed by Pearl32 Dentistry and Wellness (Masih Rezaei Dental Corporation), 24022 Calle De La Plata, Suite 450, Laguna Hills, CA 92653, and by all of its dentists, hygienists, assistants and staff. “Health information” means information that identifies you and relates to your health, your dental care or payment for it.

Your rights

When it comes to your health information, you have the right to:

  • Get a copy of your dental record, on paper or electronically, including x-rays. Ask the office. We provide a copy or a summary within the time the law allows, usually within 15 days of your written request under California law, and may charge a reasonable, cost-based fee.
  • Ask us to correct your record if you think it is incorrect or incomplete. We may say no, but we will tell you why in writing within 60 days.
  • Request confidential communications, for example that we contact you only on a certain phone or at a different address. We will say yes to all reasonable requests.
  • Ask us to limit what we use or share for treatment, payment or our operations. We are not required to agree if it would affect your care. If you pay for a service in full out of pocket, you can ask us not to share that information with your health insurer, and we will say yes unless a law requires us to share it.
  • Get a list of those we have shared your information with for up to six years before the date you ask, other than for treatment, payment, operations and certain other disclosures. We provide one list a year free and may charge a reasonable fee for more.
  • Get a paper copy of this notice at any time, even if you agreed to receive it electronically.
  • Choose someone to act for you, such as a person with your medical power of attorney or your legal guardian. We will confirm that person has authority before we act.
  • File a complaint if you feel your rights have been violated (see below). We will not retaliate against you for filing a complaint.

Your choices

For certain information, you can tell us your choices about what we share. In these cases you have both the right and the choice to tell us to:

  • Share information with your family, close friends or others involved in your care or payment for your care.
  • Share information in a disaster relief situation.

If you are not able to tell us your preference, for example if you are unconscious, we may share your information if we believe it is in your best interest, or when needed to lessen a serious and imminent threat to health or safety.

We never share your information in these cases unless you give us written permission: marketing purposes, and sale of your information. Pearl32 does not do fundraising.

We may contact you with appointment reminders by phone, text or email. Tell us if you prefer a different method.

How we typically use or share your health information

  • To treat you. We use your health information and share it with other professionals who are treating you, for example with a specialist we refer you to, or with a dental laboratory that makes your crown.
  • To run our practice. We use your information to run the office, improve your care and contact you when necessary, for example to review treatment quality or train staff.
  • To bill for your services. We use and share your information to bill and get payment from your dental plan or other payers, for example to send a claim or a pre-treatment estimate to your insurance.

Other ways we may use or share your information

We are allowed or required to share your information in other ways, usually ways that contribute to the public good, such as public health and research. We must meet many conditions in the law first.

  • Public health and safety: preventing disease, helping with product recalls, reporting adverse reactions to medications or devices, reporting suspected abuse, neglect or domestic violence, and preventing or reducing a serious threat to anyone’s health or safety.
  • Research, when the law allows it.
  • Complying with the law, including with the Department of Health and Human Services if it wants to see that we comply with federal privacy law.
  • Organ and tissue donation requests.
  • Medical examiners and funeral directors, for example to help identify a person.
  • Workers’ compensation, law enforcement, health oversight agencies and special government functions such as military, national security and presidential protective services.
  • Lawsuits and legal actions, in response to a court or administrative order or a subpoena.

Substance use disorder treatment records

If we receive records protected by federal law at 42 CFR Part 2 (records from a federally assisted substance use disorder program), we will not use or share them in any civil, criminal, administrative or legislative proceeding against you unless you give written consent or a court orders it after notice and a hearing. You may give one written consent for all future uses and disclosures of those records for treatment, payment and health care operations, and you may revoke it in writing at any time. Information shared under that consent may be shared again as HIPAA allows.

California law

California’s Confidentiality of Medical Information Act and other state laws can give you more protection than HIPAA, for example by requiring your written authorization for some disclosures. When state law is stricter, we follow it.

Our responsibilities

  • We are required by law to maintain the privacy and security of your protected health information.
  • We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
  • We must follow the duties and privacy practices described in this notice and give you a copy of it.
  • We will not use or share your information other than as described here unless you tell us we can in writing. If you tell us we can, you may change your mind at any time. Let us know in writing.

Changes to the terms of this notice

We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available on request, in our office and on this website.

How do I get a copy of my dental records from Pearl32?

Ask at the front desk or send a written request to our Privacy Officer at hello@pearl32.com. You can have your records, including x-rays, on paper or electronically, usually within 15 days of your written request.

Can Pearl32 share my information with my family?

Only if you agree, or if you cannot tell us your preference and we believe sharing is in your best interest. You can tell us who may receive information about your care.

Will Pearl32 use my health information for marketing?
